Returns and Right of Withdrawal Policy

1. Who This Policy Applies To
This Policy sets out the terms and conditions for withdrawing from a purchase, returning goods, obtaining refunds and submitting complaints regarding products purchased from the Yani online store, available at https://shop.omniumstudio.com.
The statutory right of withdrawal from a distance contract applies to consumers under the conditions set out in applicable law. If a purchase is made by a legal entity or in the course of the buyer’s commercial or professional activity, the statutory right of withdrawal granted to consumers may not apply.
This Policy does not restrict the Customer’s statutory rights in the event of defective, damaged or non-conforming goods.
2. Right of Withdrawal Within 14 Days
Consumers generally have the right to withdraw from a distance contract for the purchase of goods within 14 days, without giving any reason, subject to the exceptions provided by law.
For purchases of goods, the withdrawal period generally begins on the day on which the consumer, or a third party designated by the consumer other than the carrier, takes physical possession of the goods. For orders consisting of multiple goods delivered separately, or goods delivered in multiple lots or pieces, the applicable legal rules determine when the withdrawal period begins.
To exercise your right of withdrawal, you must inform us of your decision through an unequivocal statement within the applicable statutory period. You may use our Withdraw from purchase contract form, where available and applicable, the standard withdrawal form provided in this Policy, or another clear statement sent to our contact email address specified below.
Use of the standard withdrawal form is not mandatory. Where a withdrawal is submitted through the online withdrawal function, follow the instructions provided on the relevant page. An electronic acknowledgement of receipt will be provided where required by law.
3. Exceptions to the Right of Withdrawal
The right of withdrawal does not apply in cases provided for by law. These may include certain goods made to the consumer’s specifications or clearly personalised to meet the consumer’s individual requirements, where the statutory conditions are satisfied.
A product is not automatically excluded from the right of withdrawal merely because it is manufactured or prepared after an order has been placed. Whether an exception applies depends on the nature of the goods and the applicable legal requirements.
Where a statutory exception applies to a particular product, the relevant information will be provided to the Customer before the contract is concluded.
Other statutory exceptions apply only where the relevant legal conditions are met.
4. Returning Goods
After notifying us of your decision to withdraw from the contract, you must send back or hand over the goods without undue delay and no later than 14 days from the date on which you notified us of your decision. The deadline is met if you send the goods back before the 14-day period expires.
The Customer bears the direct cost of returning the goods, provided that the Customer was informed of this obligation before concluding the contract and unless applicable law requires otherwise.
Please package the goods appropriately to help prevent damage during transport. Including your order number in the parcel will help us identify your return more quickly.

In-person returns at a physical store are not available unless the Seller has expressly announced that this option is available.
5. Condition of Returned Goods
You have the right to inspect and test the goods to the extent necessary to establish their nature, characteristics and functioning, as you would be permitted to do in a typical physical store.
If the value of the goods has diminished as a result of handling beyond what is necessary to establish their nature, characteristics and functioning, you may be liable for the actual diminished value in accordance with applicable law. Where legally justified, a corresponding amount may be deducted from the refund.
Merely opening the packaging or inspecting the goods does not automatically mean that the right of withdrawal is lost. This section does not limit your statutory rights in respect of defective or non-conforming goods.
6. Refunds
Where the right of withdrawal has been validly exercised, we will reimburse the payments due without undue delay and no later than 14 days from the date on which we are informed of your decision to withdraw from the contract, subject to the conditions below.
The refund includes the cost of the least expensive standard delivery option offered by us, where required by law. If you expressly selected a more expensive delivery option, we are not required to reimburse the additional cost where permitted by law.
For sales of goods, we may withhold the refund until we have received the goods back or until you have provided evidence that you have sent them back, whichever occurs first, unless we have offered to collect the goods ourselves.
The refund will be made using the same payment method used for the original transaction, unless you expressly agree to a different method of reimbursement and this does not incur any additional costs for you. For cash-on-delivery orders, an alternative reimbursement method, such as a bank transfer, may be arranged with your express agreement and subject to applicable law.
7. Defective or Non-Conforming Goods
The 14-day right of withdrawal is separate from your statutory rights where goods are defective, damaged or do not conform to the contract.
If you experience such an issue, please contact us at [insert official customer service email address] and, where possible, provide your order number, a description of the problem and photographs showing the issue.
We will assess the matter in accordance with applicable law. Depending on the circumstances and the legal requirements, your remedies may include repair, replacement, a price reduction or termination of the contract.
8. Cancellation Before Dispatch
Customers may contact us to request cancellation of an order before it has been dispatched. We will make reasonable efforts to accommodate such requests, provided that the order can still be stopped before dispatch.
Cancellation before dispatch is not guaranteed and depends on the order’s processing and fulfilment status. If the order has already been dispatched or can no longer be stopped, the customer may need to follow the applicable return procedure.
Cancellation before dispatch is separate from the statutory right of withdrawal. The fact that an order has been dispatched or delivered does not, by itself, remove or limit any statutory right of withdrawal the customer may have. Where the right of withdrawal applies, it may be exercised within the applicable statutory period and subject to the relevant legal conditions and exceptions.

9. Vouchers, Gift Cards and Special Orders
The terms of use and validity period of vouchers or gift cards will be specified when they are offered.
Withdrawal and refund rights relating to vouchers, gift cards, digital content or specially manufactured products will be assessed according to the type of product, the manner in which it is supplied and the applicable legal provisions. This Policy does not exclude any statutory rights that must apply.
10. Standard Withdrawal Form
Complete and send this form only if you wish to withdraw from the contract. Use of this form is not mandatory. You may also submit an unequivocal statement of withdrawal by another permitted method, including through our Withdraw from purchase contract, where available and applicable.
