Terms and Conditions
Last updated: 26 October 2026
1. General Provisions
1.1. These Terms and Conditions govern the relationship between the trader operating the Yani online store at https://shop.omniumstudio.com and any person who uses the website or places an order through it.
1.2. The online store is operated by Omnium Studio EOOD. Hereinafter, the company is referred to as the “Trader”, and any person using the website or purchasing a product is referred to as the “Consumer” or the “Customer”.
1.3. These Terms and Conditions apply to the use of the website, browsing the products offered, and entering into and performing distance sales contracts through the online store.
1.4. By submitting an order, the Customer confirms that they have had the opportunity to review these Terms and Conditions. This does not restrict any statutory rights available to consumers.
1.5. Where the Customer qualifies as a consumer under applicable law, the mandatory consumer protection rules shall apply. No provision of these Terms and Conditions is intended to exclude or restrict rights granted to consumers by law.
2. Information About the Trader
2.1. The Trader is Omnium Studio EOOD, UIC: 205199580, with its registered business address at: Block 137A, Entrance B, Krasna Polyana 1, 1330 Sofia, Bulgaria.
2.2. Customers may contact the Trader by telephone or via the email address published on the website.
2.3. Before an order is finalised, the Trader provides information about product characteristics, prices, delivery costs and applicable terms.
3. Products and Website Information
3.1. The online store offers the products presented on the website, together with available information about their characteristics, dimensions, materials, colours, intended use and other relevant features.
3.2. The Trader makes reasonable efforts to ensure that product images, descriptions and other information are accurate and up to date.
3.3. Minor visual differences may occur between images displayed on a screen and the actual product, for example due to display settings, lighting during photography or the characteristics of the materials. Such differences do not release the Trader from its obligation to ensure that the goods conform to the contract.
3.4. Product availability is displayed on the website where applicable. If an unforeseen circumstance prevents a confirmed order from being fulfilled, the Trader shall inform the Customer and agree on the next steps, including reimbursement of amounts paid where applicable.
3.5. The Trader may change its product range, descriptions and presentation for future orders. Such changes shall not affect contracts already concluded, unless otherwise agreed by the parties or required by law.
4. Orders and Formation of the Contract
4.1. Orders are placed using the ordering functions available in the online store.
4.2. To place an order, the Customer selects the desired products, enters the required contact and delivery details, selects an available delivery and payment method, and reviews the order information before submitting it.
4.3. Before submitting the order, the Customer should check the selected products, quantities, delivery address, total price and applicable charges.
4.4. After submitting the order, the Customer receives confirmation at the email address provided, where technically possible. An automated acknowledgement that an order has been received does not necessarily mean that the order has been finally accepted for fulfilment, if the message expressly states otherwise.
4.5. Where further clarification is needed regarding availability, delivery or product characteristics, the Trader may contact the Customer before finally accepting the order.
4.6. The Customer is responsible for the accuracy of the information provided. If an error is identified, the Customer should contact the Trader as soon as possible so that it can be determined whether the information can still be corrected.
4.7. If an order cannot be fulfilled, the Trader shall inform the Customer. If payment has already been made, the amount shall be refunded where applicable, without undue delay and in accordance with the law.
5. Prices and Payment
5.1. All prices displayed in the online store are stated in euros (EUR), unless expressly indicated otherwise.
5.2. The price of the selected product and any applicable delivery charges are shown to the Customer before the order is finalised. The total amount payable is clearly displayed before the order is submitted.
5.3. The available payment methods are those displayed during the checkout process. The terms shown before the order is finalised apply to the specific order.
5.4. Where payment is processed through an external payment service provider, the processing of the payment may also be subject to that provider’s terms and policies.
5.5. The Trader may change prices for future orders. For an order already accepted, the price confirmed at the time the contract was concluded shall apply, unless otherwise permitted by law or expressly agreed by the parties.
6. Delivery
6.1. Delivery is made to an address or to a courier office where the relevant option is available at checkout. During checkout you can select your country. If your destination is not listed, please contact us before placing your order to discuss the shipping options.
6.2. Available products are usually processed and handed over to the carrier within 1–2 business days. Orders placed on a business day before 3:00 PM are usually dispatched on the same day, where possible.
After dispatch, standard delivery within Bulgaria usually takes an additional 1–3 business days. The estimated total delivery time for in-stock products is therefore approximately 2–5 business days. These delivery times are estimates and may vary due to public holidays, high demand, carrier delays, or other unforeseen circumstances. We will make reasonable efforts to inform customers of any significant delays.
Unless otherwise agreed, goods will be delivered without undue delay and no later than 30 calendar days from the conclusion of the contract, in accordance with applicable consumer protection law. This does not limit the consumer’s rights if the agreed delivery period is exceeded.
6.3. The Trader is not responsible for delays caused by inaccurate delivery details or circumstances beyond its reasonable control.
6.4. If a delivery is delayed or a delivery problem occurs, the Customer may contact the Trader for updated information and to clarify the next steps.
6.5. Upon receipt, the Customer should, where possible, check the external condition of the parcel. If visible damage is present, it is advisable to record it with the courier and notify the Trader promptly. Failure to make such a note does not, by itself, deprive the consumer of statutory rights relating to non-conforming goods.
6.6. If a parcel is not collected, the Customer should contact the Trader to clarify the reason and the available options for redelivery. Any claims for costs arising from an uncollected parcel shall be assessed according to the circumstances and applicable law. This provision does not create an automatic penalty payable by the Customer.
7. International Deliveries and Customs Charges
7.1. All applicable destinations and conditions will be stated during the ordering process.
7.2. For deliveries outside the European Union, import duties, taxes, customs clearance fees or other charges imposed by the destination country may apply.
7.3. Where such charges are not included in the product price or delivery charge, they may be payable by the recipient in accordance with the rules of the relevant country. Information about applicable charges and conditions should be provided before an international order is finalised, to the extent reasonably possible.
8. Right of Withdrawal, Returns and Refunds
8.1. Consumers have the right to withdraw from a distance contract within 14 days where the statutory conditions are met and no statutory exception applies. For purchases of goods, the period generally begins on the day the consumer, or a third party designated by the consumer other than the carrier, takes physical possession of the goods.
8.2. To exercise the right of withdrawal, the Customer must notify the Trader of their decision by means of an unequivocal statement within the applicable statutory period. Where available and applicable, the Customer may use the Withdraw from purchase contract form or the standard withdrawal form published in the separate Returns and Right of Withdrawal Policy. Use of the standard withdrawal form is not mandatory. The Customer may also submit any other clear statement of withdrawal through a permitted communication method.
8.3. Following notification of withdrawal, the goods must be sent back or handed over to the Trader without undue delay and no later than 14 days from the date on which the withdrawal was communicated, unless applicable law provides otherwise.
8.4. The Customer bears the direct cost of returning the goods, provided that the Customer was informed of this obligation before concluding the contract and unless applicable law provides otherwise.
8.5. The Trader shall reimburse the amounts due within the statutory period and in accordance with applicable law. Where required by law, a valid withdrawal includes reimbursement of the cost of standard initial delivery. Additional costs resulting from the Customer’s choice of a more expensive delivery method than the least expensive standard option shall not be reimbursed.
8.6. For sales of goods, the Trader may withhold reimbursement until the goods have been received back or the Customer has provided evidence of having sent them back, whichever occurs first, unless the Trader has offered to collect the goods.
8.7. The Customer may inspect and handle the goods to the extent necessary to establish their nature, characteristics and functioning, as would reasonably be permitted in a physical shop. The Customer may be liable for any diminished value resulting from handling beyond what is necessary for such inspection.
8.8. The right of withdrawal does not apply in cases expressly provided for by law. These may include goods made to the consumer’s specifications or clearly personalised. This exception applies only where the specific goods meet the statutory criteria; not every product manufactured after an order is placed is automatically excluded from the right of withdrawal.
8.9. The detailed procedure, return address, withdrawal form and information about refunds are provided in the separate Returns and Right of Withdrawal Policy available through the online store.
9. Complaints and Statutory Rights in Relation to Non-Conforming Goods
9.1. The Trader is responsible for ensuring that the goods sold conform to the contract in accordance with applicable consumer protection legislation.
9.2. If the Customer discovers that goods are defective, damaged or do not conform to what was agreed, the Customer may contact the Trader, providing the order number, a description of the issue and, where appropriate, photographs or other information that may help clarify the matter.
9.3. The Trader shall consider complaints and take the necessary action in accordance with the law. Depending on the circumstances and applicable statutory conditions, the consumer may be entitled to have the goods brought into conformity, including through repair or replacement, to a price reduction or to termination of the contract.
9.4. Statutory remedies are available under the conditions and within the time limits established by applicable law. These Terms and Conditions do not restrict those rights.
9.5. To submit a complaint, the Customer may use the Trader’s contact details provided in these Terms and Conditions. Written communication is recommended so that the correspondence can be documented and followed up.
10. Intellectual Property and Copyright
10.1. All rights in the content of the online store, including but not limited to designs, graphics, illustrations, photographs, images, text, logos, visual concepts, product images, layouts and other creative materials, belong to the Trader or are used by the Trader on a lawful basis, unless expressly stated otherwise.
10.2. The website content is protected by applicable legislation on copyright, related rights, industrial designs, trademarks and other intellectual property rights.
10.3. Purchasing a product does not transfer copyright or grant a licence for commercial use of the design, images or other creative materials, unless the parties have expressly agreed otherwise in writing.
10.4. Without the prior written permission of the relevant rights holder, copying, reproducing, publishing, distributing, selling, modifying for reuse, making available to third parties or otherwise using protected content beyond what is permitted by law is prohibited.
10.5. The use of images, product designs or other website materials to create or offer copies, derivative products or competing commercial offerings without the required permission is prohibited.
10.6. Nothing in this section restricts rights expressly granted to consumers by law or uses permitted under applicable statutory exceptions.
10.7. For enquiries regarding unauthorised use of content or requests for permission to use it, the Trader may be contacted using the contact details published on the website.
11. Personal Data and Cookies
11.1. The Trader processes personal data in connection with the operation of the online store, the processing and fulfilment of orders, delivery, payments, customer service and compliance with legal obligations.
11.2. Detailed information about the categories of personal data, purposes and legal bases for processing, recipients, retention periods, data subject rights and the use of cookies is provided in the separate Privacy Policy.
11.3. Cookies and similar technologies are used in accordance with applicable law and the settings made available to visitors through the website.
12. Liability
12.1. The Trader makes reasonable efforts to keep the website available and its information up to date but does not guarantee uninterrupted operation without technical interruptions or errors.
12.2. The Trader shall not be liable for temporary unavailability caused by technical maintenance, network failures, third-party services, force majeure or other circumstances beyond its reasonable control.
12.3. Nothing in these Terms and Conditions excludes or limits liability that cannot be excluded or limited by law, including mandatory consumer rights.
12.4. The Customer agrees to use the website lawfully and not to take actions that compromise its security, normal operation or the rights of the Trader or third parties.
13. Complaints and Dispute Resolution
13.1. If the Customer has a question, an issue with an order or a concern regarding the performance of a contract, the Customer may first contact the Trader using the published contact details.
13.2. The Trader shall review reports and complaints in accordance with applicable legal requirements.
13.3. Consumers may seek assistance from the competent consumer protection authorities, including the Bulgarian Commission for Consumer Protection, or use applicable statutory mechanisms for alternative dispute resolution.
13.4. The availability of a contact or voluntary dispute resolution procedure does not restrict the Customer’s right to seek legal protection through the courts.
13.5. Disputes shall, where possible, be resolved by mutual agreement. If no agreement can be reached, they shall be resolved by the competent authority or court in accordance with applicable law.
14. Governing Law
14.1. These Terms and Conditions and contracts concluded through the online store are governed by the laws of the Republic of Bulgaria, to the extent that this does not deprive consumers of protection afforded to them by mandatory provisions of applicable law.
14.2. Where the Customer is a consumer, nothing in this section restricts the Customer’s rights under applicable European Union law or national consumer protection legislation.
15. Amendments to the Terms and Conditions
15.1. The Trader may update these Terms and Conditions in response to changes in legislation, the operation of the online store, the products offered or the technologies used.
15.2. The current version shall be published on the website with the date of the latest update.
15.3. Amendments apply prospectively and do not automatically change the terms of contracts already concluded, except where permitted by law or agreed between the parties.
15.4. Customers should review the current version of the Terms and Conditions before placing a new order.
